8/6/2022-9/13/2022 6PM MST Our online only auctions are stagger style, which means that the first lot in the auction will start at 6:00pm and each item after will close 60 seconds later. Also, it has a soft close feature, if an item gets a bid right before the closing time the bidding will re-open for 1 more minute to allow for any other bids. Buyer's Premium: 16% buyer's fee (buyer's premium) will be added to all invoices. Any unpaid invoices after 4:00pm Thursday after the auction will be charged via the credit card on file. All invoices must be paid by 4:00pm the Thursday after the auction. Shipping and Handling: $5 handling fee plus cost of shipping will be charged on lot items shipped. We will combine lot items where possible. Buyer is responsible for all shipping and handling costs. Results Auction Terms and Conditions By bidding on any item, Bidder accepts and agrees to be bound by the Terms and Conditions set forth, and specifically acknowledges that these Terms and Conditions constitute a binding contract. Contract agreeance is between Bidder and Results Auction LLC known forth as Results Auction. If Bidder does not agree to these Terms and Conditions, Bidder is not authorized to make a bid on or buy any item. Inspection and Assumption of Risk Everything will be sold “as is, where is” condition, with no guarantees of any kind, regardless of statement of condition made from the auction block. Buyers shall rely entirely on their own inspection and information. Statements on Certificate(s) Of Authenticity, Grading Certificates, Valuation Certificates, Certificates of Appraisal, Gemological Lab Reports, and the like (collectively referred to herein as COA) are the opinion of the company or entity which issued the COA, and not those of Results Auction LLC. The information contained on the COA is added to the written descriptions of items solely as an attempt to fully disclose any information accompanying the item, and in no way constitutes a guarantee of the validity of the information on the COA. It is the sole responsibility of the bidder to verify the claims made on said COA before placing any bids on that item. When placing bids on item(s) accompanied by COA(s) it is the sole responsibility of the bidder to research the company or entity which issued the COA and base bidding activity on the strength of the reputation of the company which issued the COA(s). No refunds will be given due to disputes over the validity of information contained on COA(s). Every effort is made to “guard” merchandise throughout the auction; however, the bidder becomes solely responsible for all items purchased by them immediately following their winning bid. Therefore, they are advised to further guard items at their own discretion. Each party to these Terms and Conditions agrees to indemnify each other party and hold it harmless from and against all claims, damages, costs and expenses (including attorneys’ fees) attributable, directly or indirectly, to the breach by such indemnifying party of any obligation hereunder or the inaccuracy of any representation or warranty made by such indemnifying party herein or in any instrument delivered pursuant hereto or in connection with the transactions contemplated hereby. Bidding Our online only auctions are stagger style, which means that the first lot in the auction will start closing at 6:00pm and each item after will close 40 seconds later. Also, it has a soft close feature, if an item gets a bid right before the closing time the bidding will re-open for 1 more minute to allow for any other bids. Once a bid is placed, it cannot be deleted. 16% buyer’s fee (buyer’s premium) will be added to all invoices. Any unpaid invoices after 4:00pm Friday after the auction will be charged via the credit card on file. All invoices must be paid by 4:00pm the Friday after the auction. No Credit card fees are charged on top of final price. The Bidder is responsible for knowing which item they are bidding on. If they are unsure, they should inquire or not bid. When you become the winning bidder at auction you have affected a contract and will be expected to pay for items in which you were evidenced to be the successful bidder. Auctioneer will not honor “mistakes”. On-line absentee bids are accepted up until 1 hour before the live auction begins. these bids are not the final result. absentee bids become part of the live bidding action during the auction and are entered by a proxy bidder who acts on behalf of the absentee bidder. (Note: the exception of any online only auctions, which have no live portion.) Minimum bid increment is set buy price range lots are in at current time. Bids are accepted the duration the catalogue is open directly through our website (https://resultsauction.com) or via hibid.com. Our site will automatically generate and send an e-mail when a bidder is outbid or won on an auction. This is provided as a courtesy service to our bidders and is a non-guarantee service. Although rare, it is possible for our site to encounter interruptions in service or malfunctions. We reserve the right to suspend, cancel, or extend auctions that have been affected by such an occurrence. At the end of each auction, winning bidders will be notified as soon as possible via e-mail. Extended Bidding Soft Close Our auction timer remains constant all year round and corresponds with Eastern Standard Time. All auctions are set up with a 1-minute extended bidding period or soft close. The extended bidding period is initiated once an auction item that receives a bid within one minute of closing will extend for an additional minute. During the extended bidding period, all new bids reset the auction countdown to 1 minute. An auction ends when no new bids are entered for a full 1 minute. Each auction is on an independent timer so auctions will end at different times. Reserve Prices Some auction lots may have a minimum price that we are willing to accept for that lot to be sold at auction (“Reserve Price”). If bidding does not meet or exceed the Reserve Price, the lot shall be returned to the consignor or relisted into a future auction (at the sole discretion of Results Auction). Auction Fees Buyer’s Premium of 16% will be applied to all winning lots. Sellers / Consignors fee of 20% will be charged on all lots sold. Handling fee of $5 per lot charged per lot shipped. Shipping charges vary on destination, size and weight. Authentication fees for consignors start at $12 per lot. Auction Cancellation Results Auction reserves the right to cancel an auction at any time for any reason. Consignment Results Auction charges a flat consignment fee of 20%. When sending in lots for consignment, please include your contact information as well as an itemized list of the lots to ensure they are processed as quickly and accurately as possible. The Auctioneer reserves the right to accept bids in any increment he feels is in the best interest of his client, the seller. The Auctioneer reserves the right to reject the bidding of any person whose conduct, actions, or adverse comments he feels are not in the best interest of the seller. Consignors or associates of consignors knowingly bidding on their own auctions with the intention of non-payment is strictly forbidden. Failure to comply with this policy will result in an immediate ban and potential financial penalties. Our system regularly monitors for this type of restricted behavior. Any unsold lot will be placed into a future auction or returned to the consignor at the discretion of Results Auction. All lots will be live for the duration of the auction and will be sold to the highest bidder unless a reserve is not met. All reserve prices must be pre-approved by Results Auction prior to the auction going live. We will not consider the request of reserves below $100. While we will do our best to accommodate reserves, reserves should be considered a request and not a guaranteed service. It is the responsibility of each consignor to ensure agreed upon reserves have been added to each auction as desired. Results Auction will not be held financially responsible for missing reserves. Grading & Authentication Results Auction values authenticity and recognizes the importance of ensuring all autographed memorabilia being offered has been authenticated by an industry leading authenticator. Authenticators are only added to our approved list following careful review. To be considered, an authenticator must pass our extensive integrity test and must provide a verifiable and professional hologram and/or COA with each item. Please note that no authenticator has guaranteed acceptance. Results Auction, at our sole discretion, may require further authentication on an item, regardless of the authentication already included with the item. In the event we require additional authentication, lots will be authenticated in-house by CAG or JSA. Authentication fees start at $12 per lot. Results Auction will pay the authentication fee(s) initially and deduct the amount from the consignor’s account. There will be no authentication fee for Lots that do not pass the authentication process, and these Lots will be returned to the consignor. The consignor is responsible for the return shipping cost. The following list of approved authenticators may not be all inclusive and is subject to change without notice. Bidder understands that Auctioneer has not verified any such statements or opinions and does not warrant their accuracy. Bidder relies exclusively on Bidder’s own investigation and information, and assumes all risk of any inaccuracy in statements or opinions expressed by others. Grading and authentication is not an exact science, and it is possible that two people do not always grade or evaluate the same item alike. Any stated grade or condition or estimated value represents the opinion of the third-party professional whose opinion is quoted in the item(s) description. Lots that are accompanied by a Certificate of Authenticity from a third-party authenticator are not eligible for return. Absolutely no exceptions will be made regarding this policy. Given the opinionative nature of autograph authentication, autographed items which are accompanied by the Third-Party Authentication(s) listed with a lot represents the opinion of the third-party professional, and no further warranties or guarantees of opinion from outside authenticators, or so-called “experts”, is being implied or guaranteed in any way. Lots may not be returned based upon a difference of opinion in grading or authentication. It is ultimately the Bidder’s responsibility to arrive at a final conclusion on their level of satisfaction of authenticity prior to bidding. Please do not bid on a lot if you are not comfortable with the stated authentication(s) that accompany a lot. Display cases and frames are used or discarded at the discretion of the Company. Our preference is that, whenever possible, lots are sent without display cases or frames. If a Lot is sent with a display case or frame that the Company removes, Results Auction does not guarantee the display case or frame will be returned with the lot in the event the lot is returned to the consignor but Results Auction will always endeavor to return where possible. Firearms and Ammunition Sales In accordance with Federal Law every gun purchase must be approved via a federal background check. It is the responsibility of the purchaser to be aware of his or her ability to pass a federal NICS check. It is the responsibility of the interstate purchaser to be aware of the laws of their state regarding the legality of receiving any item, and for providing us with a receiving FFL Dealer in the bidder’s locale. Due to Federal Regulations we unable to sell any firearm-related merchandise outside of the United States. FIREARMS SHIPPING / STATE RESTRICTIONS: Please Check Your Local and State Laws Before Bidding, you must be 21 years or older to bid / purchase firearms, ammunition tasers and armor. You must be legal to own and not a felon. California and other states may prohibit you from purchasing ammunition and firearms that are legal in our state. It is your responsibility to know what YOU can and cannot own. Remember your bid is a binding contract. Please know what you are doing before you place a bid. All firearms must be mailed to your local FFL dealer. If multiple unsuccessful attempts are made to deliver a customer’s shipment, the shipping carrier will return the shipment to Results Auction. Results Auction may then send the shipment back to the customer. Please be advised that the additional shipping cost will be charged to the credit card provided by the customer. It is the responsibility of the bidder to verify and confirm the shipping address as it appears on each invoice (found in the sold to section of each invoice). Returns Many items offered are hand-signed by athletes and, therefore, have been handled by multiple parties in the process. For that reason, some handling wear should be expected. Although it would be our desire, very few items are perfect. Please note that some minor blemishes may be considered within the level of acceptable wear and not specifically noted by our team. Examples would include minor handling wear on photographs and frames as well as natural toning on collectables or lots. All auction sales are final except and sold in an “as is where is” state with no returns. In very limited circumstances returns are set forth below. All Lots are shown and described to the best of our ability. Please ask any necessary questions before placing a bid. If a lot has been grossly misrepresented in its description, it may be returned. If a winning bidder believes a lot was misrepresented, he/she must contact us within 7 days of receipt of the lot with written explanation and evidence of the alleged misrepresentation. If it is deemed that a gross error has occurred, it is the bidder’s responsibility to return the lot in question within seven 7 days of notice to the Company of the error. Results Auction must be notified within 7 days of the receipt of the package of any damaged, missing, or misrepresented items. Lots authenticated by an industry recognized third party or Results Auction approved authenticator may not be returned. In the event of a refund, the maximum refund cannot exceed 100% of the original purchase price. Abandoned Property Occasionally consignment items that we ultimately are unable to sell due to condition or value are to be picked up within 14 days of notification (usually via email) by Results Auction LLC, or else those items will be forfeited, to be disposed of at our discretion. In cases of abandoned items, e.g., consignment lots that we receive without the required information, lots won at auction that require additional verification of information to ship, and/or lots won at auction that are returned to us after a shipping attempt, Results Auction will hold the items for no less than and no more than 14 days. During said 14 days, we will make a minimum of 3 attempts to contact the owner of the items via email or phone. After 14 days, Results Auction will take ownership of or discard the items. Please note, any and all contact attempts will be made using the information you provide us when signing up for a user account, so keeping contact information current is highly encouraged. Disputes Bidder agrees that upon processing a credit card, debit card or other bank card, such payment shall be immediate and irrevocable, and Bidder shall not dispute, challenge, issue a “Chargeback” or reverse any such payment or charge. Any disputes, controversies or claims arising out of or relating to these Terms and Conditions, the auction of a lot, or the breach thereof which cannot be settled between bidder and Results Auction shall be decided by a single independent arbitrator. Such single independent arbitrator shall be jointly chosen by bidder and Results Auction. The parties shall name the arbitrator within thirty 30 days after one or the other has given notice to the other requesting arbitration. If bidder and Results Auction are unable to agree upon a single independent arbitrator, either party may apply to the Maricopa County Superior Court for appointment of a single arbitrator pursuant to Arizona Revised Statutes §12-1503 (or any applicable successor statute). The award made by the single arbitrator shall be final and binding, and judgment may be entered in any court having jurisdiction thereof. The cost of the arbitration procedure shall be borne by the losing party, or, if the decision is not clearly in favor of one party or the other, the costs shall be borne as determined by such arbitration proceeding. At the request of either party, arbitration proceedings shall be conducted in the utmost secrecy. In such case, all documents, testimony and records shall be received, heard and maintained by the arbitrator in secrecy, available for inspection only by a party and by their respective attorneys and experts who shall agree, in advance and in writing, to receive all such information in secrecy. In all other respects, the arbitrators shall conduct all proceedings pursuant to the Uniform Arbitration Act as adopted and then in force in the State of Arizona as presently set forth in Arizona Revised Statutes §12-1501 et seq (or any applicable successor statutes). Bidder hereby waives any right to trial by jury regarding any dispute, controversy, or claim arising out of or relating to these terms and conditions. Governing Law These Terms and Conditions shall be deemed to be made under and shall be construed in accordance with and shall be governed by the laws of the State of Arizona without the application of any conflict of law principles that would require or permit the application of the laws of any other jurisdiction and suit to enforce any provision of these Terms and Conditions or to obtain any remedy with respect hereto may be brought in Superior Court, Maricopa County, Arizona, and for this purpose each party hereby expressly and irrevocably consents to the jurisdiction of said court. Invoice totals for Out-of-state Bidders and Non-Local Bidders will be charged to the credit card on-file on the night of the auction, and at a rate of 16% Buyer’s Premium. At this time, we only accept bids from the United States and Canada. All instate buyer invoices must be paid by 4:00pm the Friday after the auction. Everything must be paid for in full regardless of when it is picked up. Online Only auctions require that all invoices are paid within three days of the auction closing. Shipping can be arranged on select items unless buyer has organized pick up or courier service. There is a $5 handling fee ontop of the shipping cost. Pickup will be scheduled after the night of the auction.
